Q: Can they take the baby back?

Q: Can they take the baby back?

Short answer: yes and no.  The birth parents/mother can change their minds up to when the sign the papers (when we get custody).  After that they can't take the baby back.  It can go to court but our social worker says there is no way they would win.  The only possibility is with the father.  Birth fathers aren't always a part of the mother's life at that point and aren't always around to sign the papers.  Once the papers have been filed they have 30 days to put in a claim with the state.  Only then can they take the baby back and that's only if they weren't present to sign the papers.

The social worker said this actually happened in the last few months.  The birth mother signed the papers and the couple got the baby.  On literally the last possible day the father filed for custody and they ended up having to take the baby away.  Apparently the birth father didn't really want the baby but his family did.  Anyways...yeah, that's horrible horrible horrible.  As hard as all this has been already, I can't imagine giving a baby back.
